LEBANON, Ohio (AP) -- A southwest Ohio man convicted of murder in the 2008 bathtub drowning of his wife wants the Ohio Supreme Court to hear his appeal as he seeks a fourth trial.
Ryan Widmer's attorney filed a notice of appeal Thursday with the Supreme Court.
The Ohio 12th District Court of Appeals in September upheld Widmer's 2011 conviction at his third trial for murdering Sarah Widmer.
Widmer's first guilty verdict was thrown out over juror misconduct and a second trial ended in a hung jury.
Widmer's appeal argues that police shouldn't have removed the bathtub as evidence from the Ohio couple's home.
Warren County Prosecutor David Fornshell says he doesn't expect Ohio's highest court to accept the case, but thinks it will affirm the lower court decisions if it does.
